California Cannabis Law
- Age Requirement: Must be 21 or older to legally possess, purchase, or use recreational marijuana.
- Medical Marijuana: Patients must have a California medical recommendation (rec) to purchase cannabis for medical use within the state. Recommendations from other states are not valid for medicinal purchases in California, even if a tourist holds a medical recommendation from their home state.
- Possession Limits:
- Up to 1 ounce (28.5 grams) of dried cannabis.
- Up to 8 grams of concentrated cannabis.
- Home Cultivation: Adults 21+ can grow up to six plants per household, for personal use.
- Medical Marijuana: Patients with a medical marijuana card can buy and possess more than recreational users, as per their doctor’s recommendation.
- Public Use: Illegal to use cannabis in public places, including parks and sidewalks.
- Driving Laws:
- Illegal to drive under the influence of marijuana.
- Cannot consume cannabis while driving or riding in a vehicle.
- Transporting Cannabis: Must be stored in a sealed container during transport. Open containers are illegal inside a vehicle.
- Sales and Purchases: Only licensed dispensaries can sell cannabis. It’s illegal to buy from unlicensed sellers.
- Employment: Employers may prohibit cannabis use at work and enforce drug-free workplace policies.
- School Zones: Cannabis use is prohibited within 1,000 feet of a school, daycare center, or youth center when children are present.
- Federal Property: Cannabis remains illegal on federal lands (e.g., national parks), even in California.
- Edibles & Infused Products: Legal to purchase and consume; must be sold in child-resistant packaging with strict labeling requirements.
- Gifting: You can give cannabis as a gift (up to 1 ounce) but cannot receive any form of payment in exchange.
